SEPTEMBER MEETING, 1941 707 fiscal year, shall be retained in the operating fund to be used by the School in subsequent years only for the purposes specified in this Section. All accrued interest arising from the investment of any part of said fund shall become part of the operating fund hereunder. No payment shall be made from such tuition fees or from funds provided by the Foundation, or the income therefrom, for general University overhead or administration. Section 4. On or prior to August 1, 1942, the University shall make a written report to the Foundation on the operation of the curriculum in postgraduate and continued education at the School of Public Health during the University fiscal year 1941-1942. IN WITNESS WHEREOF, the said W. K. Kellogg Foundation, pursuant to resolutions duly adopted by its Board of Trustees, has caused this agreement to be executed in its corporate name by its President, and its corporate seal to be hereunto affixed, attested by its Secretary, and said The Regents of the University of Michigan, pursuant to resolutions duly adopted by the Board of Regents, has caused this agreement to be executed in its corporate name by its President, and its corporate seal to be hereunto affixed, attested by its Secretary, all on the day and year first above written. The Board authorized execution by the President and the Secretary as of August 28, 1941, of the following agreement with the W. K. Kellogg Foundation (p. 519): This agreement, made this 28th day of August, 1941, between W. K. Kellogg Foundation, a Michigan corporation (hereinafter sometimes referred to as the "Foundation"), party of the first part, and The Regents of the University of Michigan, a body corporate existing under the Constitution and laws of the State of Michigan (hereinafter sometimes referred to as the "University"), party of the second part; WITNESSETH: WHEREAS, An agreement was entered into under date of December 30, 1940, between the parties hereto, under which the Foundation agreed to make certain payments to the University upon certain conditions, in aid of the Department of Pediatrics and Communicable Diseases at the University, and it is now desired to modify said agreement in the particulars hereinafter mentioned; Now, therefore, the parties hereto hereby agree as follows: Section 1. The sum of eighty-five thousand dollars ($85,000) to be paid by the Foundation to the University in installments as provided in Section 1 of the agreement, dated December 30, 1940, instead shall be paid by the Foundation to the University upon the execution of this agreement, and the University hereby acknowledges receipt thereof. Section 2. Notwithstanding the full payment by the Foundation of the total payments which were to be made in installments as above mentioned, in determining the budget for the Department of Pediatrics and Communicable Diseases during any fiscal year of the University, there shall be considered as included in the budget for that year from contributions of the Foundation only the installment which was to be paid by the Foundation during that fiscal year under the agreement of December 30, 1940. Section 3. All sums collected in any fiscal year by the University from any investments made of the sum paid by the Foundation hereunder, shall be added to the next succeeding fiscal year's minimum budget for the Department of Pediatrics and Communicable Diseases, provided for under clause (a) subsection I of Section 2 of the agreement of December 30, 1940. Section 4. The other terms and provisions of said agreement dated December 30, 1940, shall remain in full force and effect. IN WITNESS HEREOF, the parties hereto have caused this agreement to be executed by their respective duly authorized officers, under their respective corporate seals, on the day and year first above mentioned. The Board voted certain honorary degrees to be conferred on the occasion of the one hundredth anniversary celebration of the College of Literature, Science, and the Arts, October 15 next. The voting of these degrees included the usual provision that the candidates would be present in person to receive the degrees (pp. 666a and 678).
