And WHEREAS, The Architect and the University Building Committee have recommended that the contract for heating and plumbing work in the amount of $29,819 be awarded to Drake-Avery Co. And WHEREAS, The Architect and the University Building Committee have recommended that the contract for electrical work in the amount of $10,750 be awarded to the Rohn Electric Co. Now, therefore, Be it Resolved, By The Regents of the University of Michigan, That the contract for general work in the amount of $98,200 be awarded to Spence Bros. That the contract for heating and plumbing in the amount of $29,819 be awarded to Drake-Avery Co. That the contract for electrical work in the amount of $10,750 be awarded to the Rohn Electric Co. That these awards shall not be effective until the awardees have been notified in writing by the Vice-President and Secretary of The Regents of the University of Michigan of the award of the pertinent contract. The following resolution was adopted (p. 811): Docket No. Mich. 1695-F WHEREAS, The Regents of the University of Michigan entered into a Trust Agreement with Ann Arbor Trust Company, which Agreement is dated as of the fifteenth day of October, A.D. 1938, in which, among other things, The Regents agreed that barring strikes, fire, cyclone, or other act of God, it would cause to be completed "on or before the 30th day of September, 1939, a strictly modern dormitory for housing female students attending the University of Michigan, which shall be adequate in size to house approximately three hundred fifty (350) students," etc.; and WHEREAS, It appears that because of the limited time prescribed in said Agreement for the completion of said dormitory, contractors who shall bid on the same will advance the bid price at least a sufficient sum to guarantee themselves against loss should they be unable to complete the dormitory on time and be required to pay damages for such nonperformance; and WHEREAS, Under the terms of said Trust Agreement, said Ann Arbor Trust Company has authority to extend the time for completing said dormitory upon reasonable cause being shown; and WHEREAS, It appears that even if said girls' dormitory is not placed in operation until the beginning of the second semester of the 1939-1940 scholastic year of the University of Michigan instead of the first semester of said scholastic year as originally anticipated, its net earnings, together with the net earnings of the men's dormitory to be constructed in the manner contemplated by said Trust Agreement, will be sufficient to meet all payments to be made to the Trustee as provided for in said Agreement;
