SECOND NOVEMIBER MEETING, 1938 779 not hold title to sufficient real estate for such purpose and the following described parcels of real estate situated and being in the City of Ann Arbor, Washtenaw County, State of Michigan, have been selected by The Regents of the University of Michigan as a necessary portion of the most available sites for such purpose: PARCEL 1 The east fifty-four feet in length of the west one-half of lot one in block two of R. S. Smith's Second Addition to the City of Ann Arbor, Washtenaw County. Michigan, according to the Plat thereof recorded in Liber 48 page 40 Washtenaw County records. PARCEL 2 The east Ys of the east one-half of lot one, block two R. S. Smith's Second Addition to the City of Ann Arbor, being a parcel of ground five rods long and four rods wide, and WHEREAS, Said corporation now owns lands immediately adjoining the above described land, and WHEREAS, Said corporation has contracted with the owners of the fee title and land contract interest, if any, of said above described land, to purchase said lands subject to the rights of tenants in possession, but has been unable to obtain a release of the rights of said tenants at a price which is commensurate with the value of their respective interests in said property. Now therefore, be it Resolved, That the taking of the above described land and property be and is hereby declared necessary for the public use of said University and of The Regents of the University of Michigan, and that the Attorney General of the State of Michigan be requested to institute legal proceedings by law to condemn said property and that the Vice-President and Secretary of The Regents of the University of Michigan be authorized and directed to sign and verify in behalf of The Regents of the University of Michigan a petition for the condemnation of such property and all other papers necessary or proper for the conduct of such condemnation proceedings. The Secretary filed notice that the late Assistant Professor Orma F. Butler, who died June 16 last (p. 596), had left a will in which she provided for the payment of her debts and funeral and administrative expenses and made four keepsake or memento bequests to friends, and then further provided: Third: All the rest, residue, and remainder of my estate, both real and personal and wheresoever situate, including all my books, I give, devise, and bequeath to The Regents of the University of Michigan, conferring upon said Regents hereby full authority to sell and dispose of said property or any part thereof as in their judgment it may be necessary or desirable so to do and to use the proceeds as hereinafter provided. It is my wish that the money accruing in this way shall create a fund for the use and benefit of the Latin and Greek Departments of the College of Literature, Science, and the Arts of the University of Michigan, and that part at least of it shall be used to maintain a scholarship to be administered by a committee chosen from the faculties of the two Departments, this scholarship to bear the name of my mother, Fanny Burr Butler. Dr. Butler had named "The Secretary of the University of Michigan" as Executor. The Board approved the Secretary's recommendation that The Regents should accept all the remaining property left by Dr. Butler with the understanding that any of the property which it might seem wiser to dispose of should be so disposed of by the University, rather than by the Executor. The Regents accepted the bequest in accordance with its terms and conditions and authorized the Secretary to proceed along the lines recommended by him. The Regents authorized Burke and Burke as attorneys for the Board to employ additional counsel should a contest develop under the will of the late Effie M. Griffith.
