The Board considered questions arising under the will of the late
Abby K. Babcock (R.P. 1932-1936, p. 395), in particular the suggestion of the legal firm of Mitchell, Taylor, Capron, and Marsh of
New York City, to the effect that the bequest in the will to the University was secondary to a bequest therein to the Field Museum of
Chicago. The Regents being of the opinion that this was an incorrect
construction of the will formally instructed Burke and Burke, as
attorneys of the Board, to protect what is believed to be the University's prior interest to the extent of court proceedings if necessary.
