XIII. Pleas of Dependences of a former Suit.
IF the Defendant shall plead the dependency of a former Suit for the same matter com∣plained of in the Bill, and the Plaintiff shall admit of the said Plea, that then the Plaintiff shall forthwith pay to the Defendant, or his Attorney in Court, * 1.1 forty shillings Costs: And if the Plain∣tiff shall not two days before the same is set down to be heard, or sooner, admit the said Plea, and pay forty shillings Costs; then the same is to be heard in Court: And if upon hearing it shall be adjudged a good Plea, then the Plaintiff to pay three pounds Costs. * 1.2
