XXVIII. Subpaena's to be Issued by the Clerk.

BE it also Enacted, That the Clerk of the General-Court shall issue Subpaena's from the Secretaries Office, for all Evidences required in the tryal of any Cause there depending, if the Witnes∣ses required do not dwell beyond the Bay, or the North-side of James-River: And if they do, that then a Dedimus Potestatem shall issue for taking the Deposition in the County, or Counties, where the Witnesses do dwell. Provided alwayes, That in Criminal-Causes all Witnesses be bound over to give in their Evidences vivâ voce, at the tryal in the General-Court.
