APRIL MEETING, 1971 993 (7) When slates of nominees equal to the number of vacancies to be filled have been approved as provided in paragraph (6), above, the slates shall be transmitted to the Regents for their final approval. Such final approval shall constitute appointment to the University Court of Appeals. (8) If the University Court of Appeals is unable to act for lack of members, the University Council in consultation with the President of the University shall make temporary appointments to fill all vacancies on the Court. These appointees shall hold office until they are replaced by the usual selection procedures. (b) Impeachment: Any member of the University Court of Appeals may be impeached for cause. Impeachment proceedings may be initiated only by the Student Government Council, the Senate Assembly, or the Regents. The University Council shall then conduct the impeachment proceedings. It shall require an affirmative vote of at least two students, two faculty, and two administrative members of the University Council to remove a member from the University Court of Appeals. (c) Original Jurisdiction: The University Court of Appeals shall have original jurisdiction to hear removal actions in cases involving alleged violation of University Council Regulations or regulations enacted by other University bodies covering the same or substantially the same subject matter as University Council Regulations and where a proceeding has been initiated in a judiciary or other dispute-resolving body not authorized by this Judicial System. (d) Appellate Jurisdiction: The University Court of Appeals shall hear all appeals properly arising out of any judicial proceeding or arbitration within the subject matter jurisdiction of the University Judicial System. The appeal shall be heard only by members of the University Court of Appeals who did not sit as Associate Judges in the case being appealed. The University Court of Appeals may, upon making appropriate findings, sustain the decision in question, remand the case appealed for additional proceedings, reverse the conviction, or reduce the penalty imposed by the University Trial Court or Arbitrator, but under no circumstances shall the University Court of Appeals increase the severity of the penalty, or reverse a final determination of not guilty. Appeals not inconsistent with this paragraph or any other provision governing this Judicial System may be taken by either the Complainant or the Defendant to the extent provided in any relevant University Council Regulation and/or the Manual of Procedure.
