The Municipal code and the Provincial government act, being Act no. 82, entitled "A general act for the organization of municipal governments in the Philippine islands", and Act no. 83, entitled "A general act for the organization of provincial governments in the Philippine islands" as amended by the acts of the Philippine commission down to and including May 31, 1905, revised and codified by the Committee on revision and codification appointed by the governor-general. THE PROVINCIAL GOVERNMENT ACT. 69 of the fact to the Auditor and to the disbursing officer through whom the payment of salary or wages to such person is by law required to be made. If the Auditor shall find Auditor's authat a disbursing officer has paid or permitted to be paid thority. salary or wages to any person illegally holding a classified position, the whole amount paid shall be disallowed and the disbursing officer shall not receive credit for the same. If the Auditor shall find that the head or acting head of a Bureau or Office is responsible, as above provided, for the payment of salary or wages to such person and that such payment is not due to the failure of the disbursing officer to obtain proper evidence as herein required, the disbursing officer shall be directed to withhold from the salary of such head or acting head of the Bureau or Office an amount equal to that disallowed by the Auditor. A disbursing officer, the Decisions by head of any Department, Bureau, or Office, or the Auditor Civil Service may apply for and the Civil Service Board shall render a decision upon any question as to whether a position is in the classified or the unclassified civil service, or whether the appointment of any person to a classified position has been made in accordance with the Civil Service Act and Rules, which decision, when rendered, shall be sufficient authority for the Auditor in passing upon the aceount. —Act 1072, March 3, 1904. Any official in charge of a public work Oaths, adminisunder the authority of the Insular Government or any pro-tratlon of. vincial government is hereby empowered to administer all oaths required by law, without compensation, but he shall not be required to administer oaths except in matters of official business for which no fees are chargeable by law.-Act 1165, May 26, 1904. Note 15.-SECTION 1. Teachers in the Bureau of Education Teachers and and other persons appointed to office under the Insular or othersfromUnited a provincial government, who reach Manila from the United States, shall have their traveling expenses paid out of the -expenses to Insular Treasury from Manila to the point in the Islands point of duty. where their duties are to be performed. In cases where such teachers and other persons appointed have been duly authorized to bring their families at public expense from the United Families. States to Manila, the expenses allowed under this Act shall include the traveling expenses not only of such teachers and other persons but of their respective families. SEC. 2. In case of persons stationed or residing in the Phil- Local appointippine Islands who are appointed to office under the Insular ments. or a provincial government, the duties of which are to be discharged in some other part of the Islands, the reasonable traveling expenses of such persons from their former station or residence in the Islands to the place in which their future duties are to be performed, shall be paid out of the Insular Treasury.-Act 239, September 25, 1901. Note 16.-SECTION 1. * * * Insular salary and expense Salary after arfund: rival at Manila. Provided, That no salary shall be paid to any officer or employee for a period subsequent to his arrival in Manila from this appropriation when the Bureau to which he may be assigned has a vacancy from the appropriation for which he may be properly paid, or the provincial office to which he may be assigned, was vacant.-Acts 795, 807, 1049, 1225.
