156 APPENDIX. person solemnizing the marriage, that they take each other as husband and wife. carriage certifi- SEC. VII. The person solemnizing a marriage must make and cates. sign a certificate, showing: -contents. 1. The real and full names of the parties and their places of residence. 2. Their ages. 3. The consent of the father, mother, or guardian, or of one having the charge of such person, if any such be given, if the male or the female be under the age of twenty-one. For the purpose of ascertaining these facts, the person solemnizing the marriage is authorized to examine parties and witnesses on oath and receive affidavits, and he must state such facts in his certificate. The marriage shall not be performed in case of nonage, unless the consent hereinbefore required shall be personally given, by the parent or guardian or person having charge of the infant, or certified in writing over his or her signature, attested by two or more subscribing witnesses, and proved by the oath of one of them. Persons solem- SEC. VIII. The person solemnizing the marriage must, at the nizing marriages. request of either party, make a certified copy of the certificate, and transmit the original to or file the same with the justice of the peace of the district within which the marriage is celebrated, or, in default of such official, the judge-advocate or acting judgeadvocate of the military department in which the ceremony is solemnized, within thirty days after the marriage. The written consent to the marriage of a minor shall accompany such certificate. For failing to transmit such certificate or written consent he shall be fined not less than twenty-five and not more than fifty dollars. Validity of SEC. IX. No marriage heretofore solemnized before any person former marriages, professing to have authority therefor, shall be invalid for want of such authority or on account of any informality, irregularity, or omission, if it was celebrated with the belief of the parties, or either of them, that he had authority and that they have been lawfully married. Causes for an- SEC. X. A marriage may be annulled for any of the following nulment. causes, existing at the time of the marriage: -1. 1. That the party in whose behalf it is sought to have the marriage annulled was under the age of legal consent, and such marriage was contracted without the consent of his or her parents, or guardian, or person having charge of him or her; unless, after attaining the age of consent, such party for any time freely cohabited with the other as husband or wife. -2. 2. That the former husband or wife of either party was living, and the marriage with such former husband or wife was then in force. -3. 3. That either party was of unsound mind, unless such party, after coming to reason, freely cohabited with the other as husband or wife. -4. 4. That the consent of either party was obtained by fraud, unless such party afterward, with full knowledge of the facts constituting the fraud, freely cohabited with the other as husband or wife.
