40 lands, he shall be fined not exceeding one hundred dollars, and shall be punished with stripes."-Sessions, acts 1874, page 64; 1877-8, page 287, ~ 7. "If any person carelessly, negligently, or intentionally set any woods or marshes on fire, or set fire to any stubble, brush, straw, or inflammable substance capable of spreading fire on lands, whereby damage is done to the property of another, he shall, besides being liable in damages to the party so injured, be deemed guilty of a misdemeanor, and be fined not less than ten nor more than one hundred dollars."-Sessions, acts 1877-8, page 288, ~ 8. The laws on this subject in Alabama are, 1st, a special act No. 124, approved March 28, 1873: " SEC. 1. Be it enacted by the General Assembly of Alabama, That from and after the passage of this act it shall be unlawful for any person to burn or set fire to any wood within five miles of the coaling ground of any company making iron, or preparing to make the same, within the limits of the counties of Jefferson and Tuscaloosa, unless the consent of such company be obtained thereto. "SEC. 2. Be it further enacted, That any person or persons violating the provisions of the foregoing section of this act, shall be guilty of a misdemeanor, and, upon conviction, shall be fined not exceeding five thousand dollars, and may be imprisoned in the county jail not exceeding ninety days, at the discretion of the court trying the same. " SEC. 3. Be it further enacted, That for the conviction of each defendant under the provisions of this act, the solicitor shall be entitled to a fee of twenty dollars, to be taxed as costs against each defendant, and collected as in other cases of misdemeanors; Provided, That this act does not apply to teamsters. A special act for Washington county, limited to three years, was passed in 1875 and repealed in 1877. Revised Statutes of Alabama, El. 1876. SEC. 4426. (Old Sec. 3743.) Burning Woods.-Any person who willfully sets fire to the woods or forests or uninclosed lands not belonging to himself, or willfully causes fire to be communicated
