Supreme court of the United States. No. 135. The United States, appellants, vs. John A. Sutter. Appeal from the District court U.S. for the Northern district of California.

The United States vs. Sutter. 725 payment to the said plaintiff of the principal sum of six thousand dollars due on said indenture of mortgage executed and delivered by the defendants, John A. Sutter and Anna Sutter, his wife, to him, bearing date on the nineteenth day of November, A. D. one thousand eight hundred and fifty-two, together with interest on the 924 said sum at the rate of four per cent. a month from the first day of June, A. D. one thousand eight hundred and fifty-five, until the said principal sum of six thousand dollars is paid. Fifth. To the payment to the said Edward Taylor of the further sum of six thousand and fifty-six dollars, being the amount of the interest due on the first day of June, A. D. one thousand eight hundred and fiftyfive, on the said principal sum of the said indenture of mortgage to him, together with interest on the said last sum at the rate of ten per cent. a year. And sixth. If any surplus monies remain after the application of the proceeds of said sale to the payments above mentioned, then, in that case, the said sheriff is directed and ordered to bring such surplus monies into court without delay, to abide the further order of this court. And it is further ordered, adjudged, and decreed that the said defendant, John A, Sutter, pay over to the said plaintiff any de925 ficiency which may remain due to him after the application of the proceeds of said sale to the payments above designated, and that for any such deficiency the said plaintiff have execution against the property of the said John A. Sutter. And it is further ordered, adjudged, and decreed that the said defendants and all persons claiming under them subsequent to the commencement of this action, as purchasers, or incumbrances, or otherwise, be, and the same are hereby, forever barred and foreclosed of all equity of redemption in the said mortgaged premises.
