Did you have a survey made of the said grant before applying for it. [Objected to by deft.] Ans. Yes. Ques. Who made it? [Objected to by deft.] Ans. Captain Vioget. Ques. Were you with him during the time he was making the survey? [Objected to by deft.] Ans. Part of the time. Ques. Where was the southern boundary line? [Objected to by deft.] Ans. It was below Sutterville; I refer to the map for the latitude. Ques. Where were you living at the time this survey was made? [Objected to by deft.] Ans. At the fort near Sacramento. 615 Ques. What kind of property, if any, had you at that point at that time? [Objected to by def't.] Ans. Cattle and horses, and many other things too. Ques. Were there any men living with you there? [Objected to by def't.] Ans. Yes. Ques. About how many? [Objected to by def't.] Ans. The number was not equal. It run from somewhat less than en to thirty and forty; it was seldom less than ten. Ques. How much stock had you upon this grant between the time't was made to you and 1848? [Objected to by def't.] Ans. About ten thousand head of cattle, two thousand of horses, and several thousand head of sheep. Ques. How much of this stock was within the range of the fort? 616 [Objected to by def't.] Ans. Several thousand head of all kinds was upon it, and the balance was up in the neighborhood of Hock Farm, between the Sacramento and Feather rivers. Ques. Were there any improvements at the point you mention, near Sacramento? [Objected to by def't.] Ans. Yes.
