458 The United States vs. Sutler. divers mesne conveyances, to wit: A decree of M. F. Geear, as late sheriff of the county of Sutter, in the State of California, made by authority and in pursuance of law as such sheriff, under and by virtue of sale of all the right, title, and interest of the said John A. Sutter and Anna Sutter his wife, under a precept issued out of the district court of the fourth judicial district, dated the 8th day of June A. D. 1855, at which said sale John Q. Packard and Edward Woodruff became purchasers, and therefore became entitled to and received said decree last aforesaid. And that afterwards, to wit, on the 5th day of April, A. D. 1860, the said Packard and Woodruff sold and conveyed to petitioner the tract or parcel of land so described as aforesaid, containing fifty acres, or thereabouts, and he is the legal owner thereof, and still continues to be such owner, and he herewith exhibits his title to this court, and offer to file the same as part of this his petition. The petitioner alleges and shows that, by reason of the premises and such ownership, he is interested in the 201 survey of the original grant of the Mexican government to the said John A. Sutter, and by the board of United States land commissioners, this honorable court, and the Supreme Court of the States, the same stands confirmed to said John A. Sutter, his heirs or assigns. Your petitioner, being so interested as aforesaid, and being desirous to intervene in the said matter of the survey made and returned to this honorable court by the surveyor general of the United States for the district of California, and to make his exceptions thereto in conformity to law and the rules of this honorable court, prays the court that he may be allowed to intervene herein and file his exceptions to said survey within such time allowed by the rules and under the direct'on of this honorable court; and, as in duty bound, will ever, &c. AMOS PRATT. NORTHERN DISTRICT OF CALIFORNIA: United States of America, ss: Amos Pratt, the aforesaid petitioner, being duly sworn according to law, deposeth and saith he has heard the foregoing petition read, and understands the contents thereof, and the same is true of 202 his own knowledge, excepting such parts thereof stated on information and belief, and that parts thereof he believes to be true; and farther he saith not.
