Supreme court of the United States. No. 135. The United States, appellants, vs. John A. Sutter. Appeal from the District court U.S. for the Northern district of California.

424 The United States vs. Sutter. That would be so in both cases; those for and against. The work was done under direction of the foreman, and in such a way as he considered a workmanlike manner. Here is one of the tickets, which is attached hereto by the commissioner. [EAGLE.] REGULAR DEMOCRATIC TICKET, THIRD WARD. For Mayor, J. P. DYER. Recorder, PRESLEY DUNLAP. Marshal, JAMES LANSING. Treasurer, JAMES SULLIVAN. Collector, JOHN H. HOUSMAN. City Attorney, GEORGE R. MOORE. Assessor, ALEX. MONTGOMERY. Sup't of Common Schools, J. G. LAWTON. For Aldermen, SAM'L McCULLOUGH, FRANK HASTINGS, H. S. BURGESS. For School Commissioners, SAMUEL CROSS, R. A. PEARIS. Payment of $5,000 to Alpheus Felch, for legal services in contesting Sutter claims to lands within this city-YES. Q. 10. Do you not know that subsequent to the election there was a good deal of complaint, that owing to the manner in which these tickets were printed the subject did not attract the attention of those opposed to the appropriation? A. The complaint was not that they had been improperly printed, but that the committee having the matter of the tickets in charge had not used as much effort to cause a distribution of the tickets containing the vote against the appropriation as they had of the tickets for it; which was without cause, for the reason that a large portion of the tickets of both kinds were at the office, and ready for those who wanted them. Q. 11. Haven't you heard that some owners of the Sutter title voted for the appropriation without noticing it on their ticket? A. I have; Mr. Gillespie and others. Q. 12. How many officers were voted for then? A. About fifteen in all.
