I suppose the question is, ``Can the Marshal, accept command of Regt. guarding prisoners without losing the office of Marshal?'' What says the Attorney General? A. LINCOLN

[1] AES, DLC-RTL. Lincoln's endorsement is written on a telegram from Governor Oliver P. Morton, June 17, asking whether Colonel David G. Rose, U. S. marshal for Indiana, could accept command of a regiment guarding prisoners at Camp Morton without vacating his civil appointment. Bates endorsed below Lincoln's query, ``There is no incompatibility in law. And I know of none in fact, in this case.'' See Lincoln's reply to Morton, infra.
