* 1.1Romney contra Garnons & al', a Convey∣ance made to the Defendant to uses, and to their heires, for want of issue, then to such child or children of Eliz. (one of them to whom the use was limitted) begotten of her former Husband, being the Plaintiffs Father, they to whom the use is lymitted dye without issue, and before their death, did grant and devise the lands so in use to the Plaintiffe. It was thought good and de∣creed for the Plaintiff, it being but a possibi∣litie in them, and contrary to the words of the first intaile and grant, being lymitted to the Children, in 37. Eliz. li.
