A Recognizance was acknowledged at Serjeants Iune in Fleetstreet,* 1.1 and delivered and enrolled at Westminster. The Court held that it was at the election of the Recognisee to bring his Scire facias either in Lon∣don, where the Recognizance was acknowledged, or in Midlesex, where it was delivered and enrolled: But adjourned. Afterwards, viz. Pasc. 23 Car. the Court held that the Scire facias ought to be where the recognizance is ta∣ken, and not where it is recorded; for there it begins to be a Record; but this being in the Common Pleas, it was good both ways, and thereup∣on the party had his judgement.
