SYMBOLEOGRAPHY Of Fines and Concordes.
The definition of Fines.
FOrasmuch as we haue alreadie in our first part [unspec A] * 1.1 of Symboleography shewed the forme of di∣uers Conditions and Couenants, aswell for the leuying of Fines of lands and tenementes, as also to rayse and limit the vses thereof: It now seemeth necessarie to shew how the Notes of writs of Couenants and Concordes for Fines, with other necessarie circumstances concerning the same are to be made. Wherefore let vs first learne what, and how worthy things Fines be.
Tremayle 21. E. fol. 4. tearmeth Fines, couenants made before Iu∣stices, [unspec B] and entred of record.
Browne saith, Fines be fructus, exitus, & finis effectus Legis, Plow. [unspec C] fol. 357.
Glanuil in his eight booke and first chapter tearmeth a Fine Ami∣cabilis [unspec D] compositio & finalis concordia ex consensu & licentia domi∣ni Regis vel eius Iusticiariorum. And Bracton tractatu quinto Lib. 5. ca. 28. Sect. 7. de Exceptionibus saith, finis ideo dicitur finalis concor∣dia, quia imponit finem litibus, & est exceptio peremptoria.
And Glanuil cap. 3. Lib. 9. saith, Talis concordia finalis dicitur, eo [unspec E] quod finem imponit negotio, adeo vt neutra pars litigantium ab eo de caetero poterit recedere.
In which bookes may be seene thauncient forme of leuying Fines & [unspec F] their great antiquitie: for they be as auncient as any Court of Record, Plow. fol. 357. a. 368. b. which without question were long before the Conquest.
So that Fines hauing their commencement of Record long before [unspec G] the Conquest, euer since haue remayned in great estimation, as appea∣reth by a Fine leuied before the Conquest touching the possession of the Abbey of Crowland, and diuers other auncient Fines leuied before that time yet extant, Plow. 357. a. 368. b.
But chiefely we are to consider their effects, which be to make cer∣teintie [unspec H] and assurance to the parties concerning their estates in lands and tenements, and to end contention, and breed peace and securitie to all men.
