VErum superiores hae leges duas exceptiones habere debēt. Altera est, illos nō debere periuros videri, nec fidei laeso∣res, qui cum omnia summa fecerint, vt iuramentum & fi∣dem
seruarent, tamē aliqua sūt huiusmodi ratione impedi∣ti, quam vitare non poterant. Istis enim satis erit, iudicibus probare suam voluntatem & operam: secundo loco, nec illi sunt fidei laesores, aut periuri censendi, quibus exciderunt subito, nec cogitantibus, nec opinantibus, promissa rerum iniquarum, inhonestarum, aut quae fieri non possunt, vel si primum recta fuerint, & progressu temporis in hanc absur∣ditatem degenerauerint. Hoc tamen posito, & retento, quòd volens & sciens, qui rem inhonestam, iniustam, aut quae fi∣eri non possit, iurauerit, aut promiserit, illum quidem hoc crimine non teneri, si iurata non praestet. Sed tamen eccle∣siastico iudici iustas temeritatis suae poenas daturum esse.
