Auxi touts conditions sont o conditions pre∣cedent & vaiant deuaunt lestate, & sont executed, O subsequent, & veni∣ens apres lestate & exe∣cutorie.

Le condition precedēt, sait gaine & obtaine le chose ou estate fait sur condition per le perfour∣mance de mesme.

Condition implicite ou tacite & nient expresse, q̄ est appel conditiō en ley, est quant home graunt al auter le office destr̄ gar∣dein dun park, seneschal, beadle, baylife, ou tiels sembl' pur term de vie & nient obstant q̄ la ne soit ascun condition expresse en le grant, vncore le ley parle couertment de vn condition, quel est, que si le grantee ne execute pas touts points apperteināt a son office, {per} luy mesme ou son ufficient deputy, donque serra loial pur le

Condition precedent & vaant deuant est, quant vn lease est fait al vn pur vie sur condition, que si le lessee pur vie voile paie al lessour xx. li. a tiel iour, que donques il aue∣ra fee simple, icy le con∣dition preceede & va de∣uant le estate in fee sim∣ple, & sur le performance de le condition, gaine & get fee simple.

Condition subsequent & veniens apres, est quant vn grant a I. S. son man∣nor de Dale en fee sim∣ple sur condition, que le grauntee paiera a luy a tiel iour xx. li. ou auter∣ment que son estate ces∣sera, icy le condition est subsequent & sequens le estate in fee simple, & sur le performance de ycel, gard & continue le e∣state.
