¶ Audita quaerela.

AVdita quaerela, is a writ and it lieth where one is bounde in a Statute mar∣chant, statute Staple or Recognisance, or where iudgemēt is giuen against him for debt and his bodie in execution thereupon, thē if hee haue a release or o∣ther matter sufficient to be discharged of execution but hath no day in Court there to pleade it, then hee shall haue this writte a∣gainst him which hath re∣couered, or against his ex∣ecutors.
