Dear Mr. Cohen:
I refer to your letter of January 18, 1990, requesting the
release of certain Department of State documents under the
Freedom of Information Act (Title 5 USC Section 552).
A search of files under the Department's control has resulted
in the retrieval of 33 documents which appear relevant to your
request. After careful review, we have determined that 26 may
be released in full, one may be released with excisions, and
one may not be released. A decision on the remaining five
documents will require interagency coordination.
The material in the document being withheld in full has been
found to be inter-agency or intra-agency communications
involved in the deliberative process and, as such, exempt from
release under Paragraph (b)(5) of Section 552.
The material in the excised portions of the document being
released in part has been found to be of such a nature that its
release would constitute a clearly unwarranted invasion of
personal privacy and, as such, it is exempt from release under
Paragraph (b)(6) of Section 552.
In the case of a document being released in part, all
responsive material that is reasonably segregable from the
exempt material is being released.
With respect to material withheld under Section 552, you have
the right to appeal our determination within 60 days. Appeals
should be addressed to the Assistant Secretary for Public
Affairs, Department of State, Washington, D. C. 20520. The
letter of appeal should refer to the case control number shown
above.
