3. Allan Y. Wolins, M.D., is a medical doctor who
has been engaged in the practice of pediatric medicine in the
State of Maryland.
4. Allan Y. Wolins, M.D., P.A. is a Maryland
professional corporation which carries on the pediatric
medical practice of Allan Y. Wolins, M.D.
5. The Drug House, Inc., and Loewy Drug Company,
Inc., a Division of Spectra Industries Inc. are Maryland
corporations which are and have been engaged in the
distribution of defendant Lederle's pharmaceutical products,
including distribution of Orimune.
6. Orimune is an attenuated live polio virus
vaccine used for the prevention of poliomyelitis which
Lederle has marketed and sold since 1964. In connection with
its marketing and sale, Lederle has recommended administration of the vaccine to infants and represented that
individuals coming in contact with the drug would not suffer
adverse health effect.
7. On or about December 28, 1983, defendants
Wolins, and Wolins, P.A., in the course of providing
pediatric care, administered Orimune to plaintiffs' infant
daughter.
8. Plaintiff William F. Miller, Jr., as a part of
his paternal care and handling of his infant daughter, came
in contact with the live polio virus from the vaccine which
had been developed, manufactured, sold, distributed and
administered by defendants.
