Relative to item (b), I recommend that NIH be instructed to
submit its comprehensive action plan to DHSP within 60 days as
stipulated on page 16 of the report. Progress reports should be
submitted to. DHSP at intervals not to exceed 60 days to verify
implementation of the action plan and should continue until DHSP
has received and approved a revision of the NIH Multiple Project
Human Subjects Assurance that reflects appropriate improvements
in the NIH intramural human subjects protection system report.
DHSP acknowledges with approval the action noted in the NIH
response regarding Dr. Gallo, Dr. Moss, and Dr. Papas. DHSP
recommends that no research activities (including shipment of
research naterials or instruction in research technology)
involving Dr. Daniel Zagury be permitted by any HHS component or
employee without the prior written approval of DHSP (see page 20
of the report). This should apply not only to research
activities involving the NIH Intramural Research Program but to
any research activity conducted or supported by any component of
HHS.
