[Letter to John D. Dingell from Bernadine P. Healy]

Dr. William Fs Raub April 16, 1991 Page 2 NIX terminated all foreign collaborations, including all tast~ng of the AIDS vaccine. For some strange reason( no on*, eoCCOpt for' a very low at the NHf, was aware of this action. It turns out that this controversy had beein feetering at the NIH in secret a 4rnC a Mr. Crawdson had first raised the iosue with the MIRl in,& letter dated JU1y 6, 10004 Tho Subccmitt*Aj in the course of the investigation of Dra Pro= Sarin, was dealing with the issue of the apparent inability of the Gallo laborato~ry to comply vi th internal juidoliname But th~is critical, controversy involving potential violationg or human study procedu~res was never discloagd to the Subcoo= 4tteIn the course of a series of interviewsi of the relevant of ficials at tho NIH4a This "shall gaza" mentality at NIH is Unacceptable. Tho Subcommittoq staff has recently reviewed Milldocuments which reveal that the?IH knew that human subjects (in fact, two-to-ttwelve year, old children in Zaire) h~ad been injected with the vaccine -- not monkaya as soma off icials at the RN had been augured. Othar human subjects; in Prance- had alsao been injected. Yet, the NZ1i had not obtained the human subject approval as reqiuirae Now, we have learned again from ThC Chi caloTribune that, according to Drs Gallo'e attornay, DrT&&To-XlW, in January of 2.991, that there had been doaths aseccatad with the vaccin, in the program in France. Hcover, Dr. Gallo did not inform others at the NIH, This, too, is tUnacceptables I also note that, 4n the ton ionthis since Kr. Crewdzon 'Ibrought this problem to ycur attenticnt you have not dispatchad a sirnglo investi gatoz' to either Paris tr Zaire to determine the facts of the case or the fate of the zubject3 of these AIDS vaccine trials, Tha Subacomittee staff mat last zonth with your Office for Protection fromh Iasearch Risk and suqsted strongly that investiqators b4 sent immdiately to both France and Zaire, Now, we have learnod that after- the dixclo~sure of the deaths in France, the NIH is now mrely maeting with the State Vepartment to determine how this might be accomplished,*,It would appear that NIX is conducting its investigation largaly by monitoring and reacting to The C~hiqaqo Tritune. This, too, is unacceptable.
