Holt recommended that an army surgeon should examine and report if confinement would result in death, and if so, that Emerick should be pardoned upon taking the oath and giving bond. AGO General Court Martial Orders, No. 277, June 10, 1865, directed discharge of Christian Emerick from Albany Penitentiary upon his taking the oath of allegiance.
